The terms and conditions below govern your use of this Web site. Please read these carefully before using this Web site. Your use of this Web site indicates that you accept these terms. If you do not agree to these terms you must not use this Web site. These terms and conditions are required by virtue of our 501C 3 status and on the advice of our legal counsel so as you read them please understand their necessity.

Our Intellectual property rights

LSF owns or is licensed to use all intellectual property rights in and to this Web site and all technical infrastructure (including, but not limited to the software) relating to it.

You and the company or individuals you represent or that employ you agree that breach of any of these terms by you or aforesaid parties you represent will terminate your permission to use this Web site.

In the event of a breach of this agreement or notice of breach from Life Steps you agree that permission to use the site terminates and that permission for use of any materials or content included in it, automatically terminates and you agree to immediately destroy any downloads or printed extracts from this Web site.

Life Steps Foundation, LSF, LSF Group, and/or other Life Steps Foundation Affiliate, Business Unit, program names referenced herein are either trademarks or registered trademarks of Life Steps Foundation. Other program and company names mentioned herein may be trademarks of their respective owners and appear with permission.

By your access and use of any part of this Web site, you and the parties you represent agree:

• Not to use this Web site in such a way that disrupts, interferes with or restricts the use of this Web site by other users;
• Not to upload, display or transmit any materials through this Web site which are false, offensive, defamatory, threatening, obscene, unlawful or which infringe the rights of any other person anywhere in the world;

Users of Photos and Video

If you are granted access to the Web site to download photos and videos and text (the Material), you may do so only for the purpose of advertising and promoting the mission of Life Steps Foundation; to be a fiscally responsible, culturally competent organization dedicated to meeting the health, psychological and socioeconomic challenges of individuals through their life span. (the Purpose).

Material contained in this Web site may accordingly be downloaded, viewed and printed for use in the media, including print, broadcast and electronic media provided that Life Steps Foundation is attributed as the source and no trade mark, copyright or other proprietary notices contained in or appearing on such material are removed in whole or in part.

Material must not be reproduced or exploited for commercial gain but only in pursuance of the Purpose. All other rights are reserved and users must seek LSF's permission before making any other use of material contained in this Web site.

You shall be responsible for obtaining all authorizations, consents and releases and pay all compensation required by applicable collective bargaining or individual contracts or otherwise required by law. Your use of the Materials shall not be derogatory to or critical of Life Steps Foundation, Life Steps Foundation clients or any officer, director, agent, employee, or affiliate of LSF.

The Material shall not be altered in any fashion except as expressly authorized by LSF in writing. You use constitutes your agreement and the agreement of parties you represent that you or your principals shall indemnify and hold harmless LSF, its officers, directors and employees from all loss, cost, damage, liability and expense, and reasonable attorneys’ fees that LSF may incur by reason of your use of the Material in any manner not authorized by these Terms of Use.

You shall have the right of use of materials on the web site in order to access the Web site materials limited to the purpose stated herein and so long as reference is made to the sites or links contained herein.

No other rights to the intellectual property or the software, or any enhancements or modifications thereto, provided for the limited use as stated may be made by you or your employer or principals other than as granted herein.

You may not sublicense, assign or transfer any licenses granted by LSF, and any attempt at such sublicense, assignment or transfer shall be null and void and you and your employer or principals agree to indemnify and hold harmless Life Steps from damages resulting from misuse of the web site or information contained therein.

Users who are posting and submitting material

LSF may at its discretion allow users to upload or post content to individual user pages or to certain areas of the general Web Site (each a Submission). LSF may in its sole discretion decide whether or not to use a Submission.

LSF is hereby licensed to edit, change and remove all content posted to the Web site. You represent, warrant and agree that you or your employer or principals will not provide any Submission which is subject to the rights of another person without first obtaining their express authorization and that you are responsible if your Submission injures another person and you and your employer or principals agree to indemnify and hold harmless Life Steps from damages resulting from misuse of the web site or information contained therein.

(b) That LSF is under no obligation to treat your Submissions as confidential or proprietary information; and

(d) By posting Submissions, you automatically grant to LSF, and you represent and warrant that you have the right to grant, an irrevocable, perpetual, non-exclusive, transferable, fully paid, global license to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part), distribute, create derivative works of and sublicense your Submissions for any and all purposes.

(e) You understand that your Submissions may be used and republished.

This Agreement contains the entire agreement of the parties. No other agreement, statement, or promise made on or before the effective date of this Agreement will be binding on the parties.

Severability in Event of Partial Invalidity

If any provision of this Agreement is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire Agreement will be severable and remain in effect.

Modification by Subsequent Agreement

This Agreement may be modified by subsequent agreement of the parties by an instrument in writing signed by both of them or an oral agreement only to the extent that the parties carry it out.

Life Steps Foundation understands the importance of protecting your personal information, and we have created this Privacy Policy to inform you of how we will use your personal information and how you can communicate with us about your preferences.

BY ACCESSING AND/OR USING THE WEBSITE, YOU HAVE AGREED TO 1) abide by the practices described in this Privacy Policy, as may be amended from time to time, and 2) the transfer, processing and maintenance of your personal and sensitive information in the United States of America.

THE PERSONAL INFORMATION WE COLLECT:

Depending on the type of communication or transaction, the personal information we collect may include, but is not limited to, your name, postal address, ZIP code, telephone number, organization name, e-mail address, credit card, bank information or billing information.

You will be asked to provide your personal information when making donations, registering on certain pages of the site, requesting communications from Life Steps Foundation, participating in the social networking aspects of the site and/or in other ways as will be described in this Privacy Policy. WE DO NOT KNOWINGLY COLLECT INFORMATION FROM CHILDREN:

Our Web site is intended for general audience and we do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to provide us with their personal information.

If you are under 13, do not send any information about yourself to us, including your name, address, telephone number, or e-mail address. In the event we learn that we collected personal information from anyone under the age of 13, we will delete that information as quickly as possible. INFORMATION SECURITY:

Life Steps Foundation has established safeguards to help protect your personal information, but cannot guarantee that your personally identifiable information will never be disclosed in a manner inconsistent with this Privacy Policy (for example, as a result of unauthorized acts by third parties that violate applicable law).

To protect your privacy, Life Steps Foundation uses passwords to help verify your identity before granting access or making corrections to any of your personal information. All on-line transactions are done on a secure server.

This means that information entered on the transaction page is encrypted using SSL (Secure Socket Layer) before transmission. On secure pages, a "closed" lock symbol is displayed in the bottom part of your browser screen and the website address in the address bar at the top of the browser screen starts with an "https" instead of an "http".

LIFE STEPS FOUNDATION MAY SHARE YOUR PERSONAL INFORMATION:

Life Steps Foundation may use your information to: complete your donations; contact you about our on-going work; discuss employment opportunities and ways that you can further support our efforts to support our mission; fulfill your requests for products, programs, and services; communicate with you and respond to your inquiries; conduct research about Life Steps Foundation programs, services and Network; help offer you other programs or services that may be of interest.

We may also share your information with other Life Steps Foundation Affiliated Programs so that we may provide any requested services or information at the local level. For example, if you are requesting a calendar of events in your area, we may share your e-mail information with the local Life Steps Foundation Affiliated Program so that it can provide you with that information.

Your personal information will also be used to provide you access to the various sections of our website that have been personalized for your needs. Life Steps Foundation may share, rent or exchange donor names and postal addresses with third parties. Except in the limited circumstances outlined herein and below, Life Steps Foundation will not intentionally share your e-mail addresses, phone numbers or financial information.

EXCEPTIONS:

Life Steps Foundation reserves the right to share your personal information in certain situations:

1. Credit Card Transactions, Electronic Fund Transfers, Payments by Check or Money Order and On-line Transactions. Life Steps Foundation uses third parties to provide credit card, bank, payment and information processing services.

If you choose to make a donation on-line, by phone, through the mail or by other means we will share your personal information with our processing service providers. While we believe these other companies will treat your personal information responsibly, we do not own or control them and cannot guarantee your privacy.

2. Necessity.

If we have reason to believe that there has been some inappropriate interference with or use of our website, communications, or charitable services, or if we have reason to believe that one of the Life Steps Foundation website users, donors, employees or other related parties may have been injured or may have harmed some other party, we will disclose, without notice to you, personal information as we deem appropriate or if compelled by a legal or regulatory authority.

COOKIES AND PIXELS:

A "cookie" is a small piece of data that is sent to your browser from Life Steps Foundation's web server and is stored on your computer's hard drive. Cookies are used to collect non-identifying information about the user, such as Web surfing behavior or user preferences for a specific website.

Life Steps Foundation uses two different types of cookies – session-based and persistent cookies. Session-based cookies expire at the end of a browser session so once you close your browser the cookie simply terminates. Persistent cookies remain on your computer until you remove them.

Persistent cookies are used to provide internal Website analytics. You can manually delete all cookies including persistent ones within your browser privacy settings menu. If you use Life Steps Foundation communications tools to disclose information about yourself publicly (for example, in message boards made available by the Life Steps Foundation Network), other online users may obtain access to any information you provide.
